She has a right to refuse the test, either breathalyzer or field sobriety (listed in the 4th and 5th Amendments of the US Constitution) if she wants.  She may allow the police to build evidence against her, but that is her choice.  But unfortunately,  most people don&#039;t know the law.</description>
