In this “Live Free or Die” state if you idle your car longer than 5 minutes and the temperature is above 32 degrees you’re looking at the possibility of being caged like an animal for up to a year.  If the temperature is above -10 degrees but below 32, you get another ten minutes of idling before said imprisonment could become a reality.

How compassionate of the legislature to allow you to stay warm in frigid temperatures for another ten minutes before authorizing your freedom be stripped away and you be branded a criminal.

Section 125-C:15

III. Any person who violates any of the provisions of this chapter, or any rule adopted or order issued under this chapter, or any condition of a permit issued under this chapter shall be guilty of a misdemeanor if a natural person, or guilty of a felony if any other person.

Env-A 1101.09  Operational Requirements for Gasoline-Powered Motor Vehicles.  The owner or operator of a gasoline-powered motor vehicle shall comply with the following operational requirements unless specifically exempted from the operational requirements for gasoline-powered motor vehicles:

(a)  When the temperature is above 0 oC (32 oF), a gasoline engine shall not idle for more than 5 consecutive minutes;

(b)  When the temperature is -23 oC (-10 oF), 0 oC (32 oF), or anywhere in between the 2 temperatures, a gasoline engine shall not idle for more than 15 consecutive minutes; or

(c)  When the temperature is below -23 oC (-10 oF), and where no nuisance is created, a gasoline engine shall not be subject to idling restrictions.

    The unintended consequence is that people will rev their cars up every five minutes, thus polluting the air even more.

    I don’t think anyone (police included) know about this law.

    You’d better believe that the police would find out about it if they wanted to target someone for something.

    Man, some web site. Back in the 60′s we demonstrated against Vietnam and you kids dance around topless, smoke weed, and antagonize the cops with open display of guns. Take it from me, even the “real” war and government resisters are laughing at you “kiddies.”

    Hey Tom. Thank you for reading here and posting even if you think we are some sort of joke.

    I must ask, do you think that a law which authorizes putting a human being in a jail cell for a year for doing nothing more than idling a vehicle for six minutes is something that is no big deal?

    I am using this C.R.A.P. video to draw attention to another silly victimless law the state has in its arsenal. Do you really think educating the public is a joke?

    He saw the sign and shut off his idling engine.

    Good thing a sign was there. Ignorance of the law is no excuse to breaking it.

    Even though 99 percent of police officers and attorneys in this state who are finding out about this law only because they’re reading this post… You’re still obligated to follow this law.

    You’re obligated to follow every law. Which means you must know them all. Impossible? Too bad.

    A corporation.

    The state can’t put a file folder in a jail cell…. but it sure can extort lots of $ from it.

    Felony charges have a much higher monetary fine ceiling.

    Boy,that was a close call!! Although it look like he is sort of ‘idling’up against the sign.That may be illegal as well.Do you suppose anyone has/will ever be prosecuted for this,or is it one of those ‘rules’ that they use to add to any other charges they may be working up?And yes,what about any protests against the war? Or are we all OK with this one? —bil

    I noticed the law (as posted) doesn’t mention diesel engines? I used to have a Merc diesel and those things idle obnoxiously loud! I wonder if you can skirt the law with one though.

    By your failing to answer my question about your logic of attacking us here at Free Keene, I can only come to the conclusion that you think that the potential caging of a human being for a year for idling a vehicle for six minutes is an appropriate thing.

    One more thing… you said that people “antagonize the cops with open display of guns.”

    Do you realize that under your logic, someone holding a sign saying that the public should vote down the new police union contract would be “antagonizing the cops”?

    Open display of a firearm and holding a sign are both constitutionally protected activities. There is no difference.

    Actually, Byron didn’t idle his car… there was no car there. I saw the sign and thought it would be funny to add that bit in there; however, he just made the motion with his keys, and we added foley (the sound of the car idling, then shutting off) later.

    Of course you are correct.

    But the possibility is there… and the possibility is very real. These words on paper authorize violence to be used against you for simply idling your car for six minutes on your own property. To me, it is insane.
