KPD Attempting to Destroy Seized Property

This past Tuesday, Heika was arrested after using a megaphone to speak in front of the Keene District Court. It’s worth noting again, Heika was not warned that her behavior would lead to arrest or seizure of property; police just walked up and arrested her.

The police took the megaphone, which was no longer in Heika’s hands, as evidence to be held for her court date. Heika’s charges were fully dealt with on Wednesday morning in a plea deal, but she had not been given the megaphone back yet.

Now, Keene Police are asking for the court’s permission to destroy or sell the megaphone! It does not belong to Heika, nor does it belong to the police, of course. But they have filed a motion to “Destroy Contraband and/or Forfeit Property and Destroy or Sell Same”. Essentially attempting to permanently keep this piece of property, which is not illegal to own, out of the hands of it’s owner.

    How much does a megaphone cost? I say buy 2 more and show up to protest at the court house. Show them that megaphones are like the Hydra.

    They’ve already “undermined public confidence in the criminal justice system”. With this in mind, it would only be fair to “destroy” the offending instrument by dissolving the Keene Police department.

    The next step would be to implement private security that would actually be accountable to the employer. Now *that* I’d gladly sacrifice a megaphone for.

    The actual owner or one claiming it should apply for it to be returned.It may be evidence in a case of police wrongful seizure,and thus must be preserved.
    That is not their property.The unlawful use part is very doubtful.A disturbance should not rise to the importance where the horn must be destroyed.This is usually reserved for items that may prove dangerous if released,such as guns or knives used in a crime,or evidence that has been damaged and not claimed.The owner should definitely file for its immediate return.Since she plead guilty,was it ever entered into evidence?When the police took it from another individual,is it a certainty that it is the same one Heika used,and not an exact duplicate-i.e. could there have been TWO of them on the scene,and they took the wrong one?It seems pretty petty that they want to steal this.Dickheads.Don’t they realise that even a lot of folks on this site don’t really agree with the use of the bullhorn (they do read here) and if it is given back,will probably not be used except in emergency.Whereas if they insist on stealing it,there will be more trouble,and more of them will end up being bought and used? Look around at tag sales for old ones,they don’t have to work,just be carried. —bil

WTF???…For the record, as a keene native, & registered independent voter, returning the megaphone will NOT “spark outrage” in me, nor will it “”"spark” “disgust”, or “outrage”, or “incredulity.”"”"…I am ALREADY DISGUSTED, OUTRAGED, and INCREDULOUS at the cops&courts game here!!

    Is there a thread on the legal argument the owner of the bullhorn plans to make? Because I think they have a good case to get the bullhorn back. I’ve looked at NH law a little bit and, in this case, it would favor the owner.

    Also, since the police are trying to ‘steal’ this bullhorn, it feels like they are stepping up their game. So, if this happens in the future, people should be prepared with their argument. Is anyone working on a brief?

    This is beyond absurd.
    So, extrapolate this out…the shoes a fleeing criminal wears…the car a speeder drives…the house a person is in when any “crime” occurs…the barking dog…the cooler your beer is in…there is no end
    Remember…ownership doesnt seem to be an issue here…so anybodys property can be seized, without their knowledge or warning…if someone allegedly uses it to commit some state decreed “crime”?

    There is no thread regarding it probably due to privacy concerns with police reading our public forum. I would direct any ideas you have to Lance on the forums. – Or feel free to start a thread for discussion on this, if you don’t mind the government people reading them.

    I think this was a poorly thought out move on their part.As I posted above,the use of the bullhorn has proven to be a divisive issue here,and I personally don’t think it would have been used again.Given that they got a coerced plea out of Heika,they should have chalked up one in their plus column and moved on.However,by making this latest move,they have practically gauranteed the bullhorn saga has only begun.By stepping to the edge of legality,they are proving the point that they can make up the rules as they go,and there will be more bullhorns than ever,even if not used,they will be displayed.Bad move on their part.
    As for Johns comments above-they already have those powers.Used mostly in drug cases,they have confiscated boats that have been so evil as to have had joint-smoking youngsters aboard,houses that were growing pot,and cars that drove around with pot inside.All of these things have been done,and in many cases,the owner wasn’t aware of the mis-use.Kids using parents boats and cars,rental property,etc.And not just for large amounts,either.In one case,a man bought a Suburban that was being sold at a police auction.It had been seized by the DEA with a large stash inside.After he had bought it ,from the government,it started running bad.He took it to the garage,and they found that one of the gas tanks was full of bagged pot,the DEA had missed it! He called them,they then seized his Suburban,and tried to find charges to hit him with.That didn’t work,but they kept the car,and his money,too.Last I heard it still hadn’t been resolved.Also,don’t get caught traveling with a large amount of cash-it may be a sign you are planning a drug buy,and it can be confiscated as evidence.These things really happen.I myself was pulled out of line at Bradley a few years ago for having a large wad of cash.They wanted to know why I had so much money on me.(it was only 7 grand,not a million or anything like that) I told them it was in case i wanted to buy something.They wanted to know what I might want to buy.None of their business,I hadn’t decided yet.They jerked me around a while,then suddenly I was free to go.So don’t think they can’t just grab what they want,how do you think they get those fancy expensive cars they use in the undercover drug stings.They stole them.
    They can also take anything they suspect was purchased using il-legally gotten money.Fuckers. How about them with their il-legally PRINTED money?? —bil

    The “why” as to the reason they want to destroy the megaphone just might be that the victories over the police and Keene gooberment have most indeed been many. They have also been quite disheartening for Mr. Cop. His coffee is likely diluted with many salty tears and thus unsuitable for donut dunking. :)

    This is one of their few chances to frolic and rejoice over what they believe will be the destruction of a “Free Stater’s stuff”. It also shows folks even more proof that violence against property is part of what leviathan is also about. In their narrow mindset, you simply may not do what you want with your goodies if it offends the hypersensitive feelings of a cop or judge.

    To deny this vile opportunity to crush the megaphone would give them a double whammy case of the doldrums.

    That is just patently absurd.

    If, for whatever reason, they go through with it and take permanent possession of it with the intent to “destroy” it, I say just check their garbage dumpsters every day or two. Actually destroying it takes more effort than what they are willing to put forth. They’ll probably just throw it out, since that’s easier.
