The first of the “Trespassive Twelve” faces trial for the horrible crime of walking on “public” property. Of course, he was found guilty, but is appealing.

    I stopped watching this video clip after the first 10 minutes because I was so disgusted by the person that was giggling. Today I had to stand in this courtroom before this judge and ask for a protection order against my spouse. It was a very serious matter and could not imagine an individual reacting to another person like this. I am simply appalled by this crude behavior.

    And, THAT's what bothered you, rather than the idea of throwing a dozen people in jail for doing nothing more than WALKING on property they were forced to pay for?

    Yes, that is what bothered me- because today if that would have happened I would not have known the difference of what they were laughing at. There was no clarification from the people laughing. I would just have heard laughter at my being violently assaulted by my husband. So yes, THAT is what bothered me.

    I don't think they would have laughed at your hearing, unknown. They were only laughing because of the specific subject matter of this trial.

    And, again, I am very sorry to hear you have been the victim of violence by your spouse. I hope he indeed stays far away, and I hope he is required to make full restitution for the harm he has caused you.

    Sir, "de novo" means anew without any regard for the previous trial.

    The verdict of the district court bears absolutely no weight on the jury trial.

    Thanks, Bradley, for the "de novo" explanation…I remember what that means, now…Since jury trials in NH are basically "not-gonna-happen", for a year or two, maybe, it's kinda' a moot point, isn't it???…

    You're most welcome… and you're most right about the jury trial system being jammed up.

    The upsides to requesting a jury trial are vast:

    - Possibility of nullification.

    - Publicity.

    - Clogs the court system.

    - Cost the state lots of $.

    The downside is that one remains on bail the entire time pending the trial… giving the state a big piece of leverage over their life.

    It may not happen for a long while….. but if that is the case there could be speedy trial arguments to be made and all sorts of other things.

    I recommend jury trials for everyone :)

    My god. I gave up at 13:00…got sick to my stomach. I remember that first witness, "Major John Mousseau", from when he was a clerk at Cumby's, over 15 years ago, now! He looks fat, flabby, out-of-shape, and even more morose than I remember. He used to keep himself in much better shape. Sad…and, when you were also a *BAIL COMMISIONER*, Mr. John Mousseau, you *EXTORTED* $30. out of me, in 2005/2006. Remember *THAT*, John???…I sure do…You still OWE ME that $30. *BACK*, John!…Before the camera zoomed in, at first, I thought he was *EVIL*LITTLE*PIGGY* Eli "E-LIES" Rivera!…If anybody wonders what's wrong with the American justice system today, I can think of no better example than this. We, -the TAXPAYERS & CITIZENS – have to watch our hard-earned dollars WASTED on this *STUPID* *PETTY* *BULLSHIT*…I have even less respect, now, for that fucking little judgeburke, that piece-of-shit RIVERA, and the NH legal system in general…I didn't know that was possible…YO! RIVERA! Why not just title the videos with the docket #???…Why call the videos "Free-Staters"???…And, Rivera, maybe you should actually *PRACTICE* using that fancy new digital technology, before you trotted out this dog-and-pony-show…You look like a drunken retard, trying to explain the time-stamp discrepancies & operate the audio-video equipment.     …the OTHER downside is that this can't possibly get before a jury before mid-to-late 2011, AT THE EARLIEST…this could well drag on until 2012, or even 2013…Think about it, Jardis…No, I still say the charges should have been dropped at arraignment, if not before…What a waste…
