NH to Cage Peaceful Nurse

New Hampshire’s highest court has upheld a woman’s marijuana-growing conviction, ruling she had no reasonable expectation to privacy in a wooded area of her property from which police observed her house and detected the smell of marijuana coming from a vent.

Patricia Smith of Haverhill was charged in 2009 after police raided her house and found a pot-growing operation and 120 plants. During court proceedings, a superior court denied Smith’s motion to suppress evidence.

In appealing to the New Hampshire Supreme Court, Smith’s attorney argued that police violated Smith’s constitutional right to privacy and protection from unreasonable searches when they essentially conducted a stakeout in the woods behind her home.

The arresting officers said they drove by her house and saw a heater vent and later when the vent went off they smelled marijuana. I don't believe that since the vent is at the opposite end of the basement where her "dangerous cultivation" was taking place. What they smelled was heater exhaust, it's a power vent for a heater in her basement. They said that to procure a warrant and protect the identity of their informant.

They also trespassed on private property (her neighbors) to get to her property to conduct their spying. They admit to being on her property and stated they were about 60-70' away from the house. That's a bad judgement of size. The lot lines of her property are 97' feet on one side and about 115' feet on the other. The size of her front yard and the width of her house would indicate they were more likely just 30' from her house when they were on her property without a warrant.

There are several other inconsistencies but the bottom line is private property protection took a HUGE hit in this Supreme Court decision and a peaceful woman is being treated like a harmful criminal. That' wrong, all who particiapted in this should do some soul searching.

you'd be surprised at the number of addicts that are nurses. Easy accessability to pills, but those aren't really much of the problem. I've personally seen nurses drinking at work in several different hospitals. Marijuana, cocaine, meth. . . it's all there.

In my drinking days I stayed at a rehab facility with a nurse who told me that she drank everyday before work just to get through the day. It's a real problem.

4 years in jail isn't going to solve anything. Here's to Enslave getting a drinking nurse when she's popping in a catheter. I'll drink to that!

Those cops didn't just pick her, an informant neighbor turned her in. That formula of "tell on your neighbor" foster's a Police State mentality. One other irony is the police always seeem to "forget" the names of the informant. In many instances the informant is a "real criminal" that actually harms others or their property.

The number of plants reported was not accurate either, not that it should matter. Cannabis according to Judge Francis Young, a DEA judge in a 1988 ruling is not a harmful substance.

Even more irony… a very harmful drug is sold by the state, alchohol sales in 2011 = $534 million in NH. You'd think the State liquor store in Bristol, NH would be concerned about "the children" since there is a daycare center in the same strip mall building.

Another point has anybody ever seen the published NH controlled drug schedule? You know the one that complies with RSA 21:32 ? The one that the Commissioner of Health and Human Services is supposed to publish but hasn't?

In Fitchburg Massachusetts earlier this week FBI chainsawed the WRONG door down and held a mother and child at gunpoint until they FINALLY realized they had the wrong address. there are many instances of Police aggression, for instance in Missouri cops shot the family dog and terrorized a family for an early AM "pot bust" that yielded VERY little. That's terrorism.

"Real criminals" initiate aggression and do not respect another persons natural right to peaceful self ownership. Natural rights are supposed to be protected in New Hampshire, not stolen. Art. 2 NH Constitution expounds on this, but commonsense also should suffice to obviate this.

Being "sorry" would be appropriate if Patricia had harmed another person or stolen from them. In this instance Patricia's money was stolen and she was harmed by strangers with guns that work for an organization that decides what people can or can't do with their own body and property. In a rational and just world she is owed the apology and I think even the trolls know that.

That's probably the reason why one of the arresting officers could not hold my eye when I lectured him on his immoral act the day of Patricia's trial. His reponse was a meek "we don't go after people, but we HAVE TO if an informant tells us. He had at least a moment of remorse and reflection. Maybe there is hope for him.

It's amazing that after 40 years of failure, while caging nearly a million of our fellow Americans and wasting a cumulative $40 Billion, annually, the Powers that be are asking for more time and more money.

Legalize and Regulate marijuana as we do alcohol. Legal venders won't sell to minors but Black Market Dealers will sell to everyone.

Ironically, the State sells Alcohol on the highway but rails against marijuana.

I submit that World B. Free would come down on the side of liberty if he were asked.
