Judges Ruling: Darryl W. Perry vs City of Keene, et al.

I’ve been waiting to make this post, partly because I wanted to make sure it would be the final post about the case.
A Lady Judge, whose name I don’t remember and can’t make out, dismissed the case. It was dismissed after the Hearing on the Motion to Dismiss because the court claims I supposedly “failed to state a claim upon which relief may be granted.” The Judge did not adress the immunity claimed by the defense, nor did she mention Article 10 which states there are not to be two classes of men.

The order does not specify whether or not I am being ordered to pay attorney fees for the defense, and no further order has been sent. For the past two weeks, I’ve been debating about whether or not to file an appeal to the NH Supreme Court. I have decided against doing so, as the Supreme Court likely would not rule on the Article 10 arguments brought forth in my case in motions and responses to motions.

    Is this a surprise? You said your civil right were violated because you got woken up? What if my neighbor wakes me up with his lawnmower? The noise from his lawnmower comes across my property line into my private bedroom and wakes me up. You think I should be able to use the courts to get some money out of him for that?

    I watched that video. That judge gave you every chance to make a case. She asked you straight up what law got broken. She sat there with her mouth shut and let you say whatever you wanted. You could have gone nuts, citing chapter and verse, quoting Oliver Wendell Holmes, whatever. You’re telling us that in all the volumes and volumes of laws on the books you couldn’t find one single case, one statute, one clause of one regulation to support your case?

    I could see in the judge’s eyes she sided with you. She wanted you to win. She gave you the floor and did everything but send you an engraved invitation to give her an excuse to bust those city workers. That decision she wrote was legalese for “ya got nothin!”

      Why am I full of crap? Because you say so? Who are you? You use the word hypocritical even though you obviously don’t even know what it means so why should anyone take you seriously? If you had a leg to stand on you’d be posting that instead of telling me I’m full of crap–twice, like an eight-year-old. You have the same problem as the guy in the video: lots of opinion backed up by no reason. Actually the guy in the video sounds like a college professor compared to you.

      Damn you are simple. Yes, David, you’re absolutely right: being woken up by someone whom you know on one side of an imaginary line is different than being woken up by someone you don’t know on the other side of that imaginary line: one guy is your neighbor and the other guy is a stranger. And you know what else, David? A guy named Fred committing murder isn’t the same thing as a guy named Bob committing murder, because one guy is named Fred and the other Bob. They’re not the same thing. But just because two situations are different doesn’t mean that a freestater should get some free money courtesy of the taxpayer because his sleep was interrupted when he can’t even explain to a judge which law has anything to do with his case.

      And thanks for telling me what I believe. I’m glad you have access to the internal state of my brain. Next you should try accessing your own brain.

      Lara, I wanted an apology! The City officials did not apologize, so I filed a lawsuit seeking an apology and restitution. Had they simply apologized for waking me, there never would have been a lawsuit to begin with.

      In any event, I’d like to thank you for the outstanding entertainment. I think you should do more to share your skills with the world. I have an idea: next time a freestater appears in court, you should represent him. I can just see it now…

      Judge: Mr. David, could you provide the court with any legal authority for your client’s position that he’s entitled to compensation for being awakened at 9 am?

      David: Yes your Honor, they’re full of crap…and they are liars…and they are hypocrites…….also, I want to make sure the record reflects that they’re full of crap….even a child could see it….in fact,just today I was able to get an eight-year-old to agree with me that they’re full of crap….the prosecution rests.
