I&#8217;ve never sought to be kidnapped and caged. Yet that&#8217;s happened five times not because I harmed person or property, but because I asked questions of those who operate as if they have extra rights.</p>
<p>The surest way to curtail such rampant unaccountability is not to hide or remain silent when you or a friend is harassed but to be vocal &#8211; to stand-up for your rights and point-out the claimed double-standards. Failure to do so for even the most trivial of transgressions only bestows upon such actions tacit consent and sets the stage for even more egregious actions.</p>
<p>Transparency is key.</p>
<p>The purpose of this post, which houses all information related to these less-than-ideal situations is three-fold: first, to help hold accountable those who initiated force; second, to serve as an example to others who too have been forced to engage in damage control when targeted by aggressors who purport to &#8220;serve and protect&#8221; in the hopes that lessons can be imparted; and third, to encourage critical thinking about the nature of &#8220;law enforcement&#8221; in the hope that a better alternative can not just be imagined but implemented.</p>

<blockquote><p>Advocates of marijuana legalization gathered at the Statehouse on April 20, to push their cause, march in the plaza, and even fill the Hall of Flags with anti-drug war lyrics to the tune of Christmas carols.</p>
<p>The rally – 420 at 4:20 on 4/20 – was a collection of advocates, users, and other “liberty-minded” individuals, pressing their belief that drug laws are more harmful than good and that they should be allowed to smoke if they want to.</p>
<p>The advocates gathered outside the plaza for a litter pickup before the rally. At 4 p.m., Rich Paul, an activist from Keene, spoke from a megaphone, saying prohibition earlier in the nation’s history caused needless death and destruction. Paul even pointed to the recent shootings in Greenland that caused the death of the police chief there.<span id="more-17196"></span></p>
<p>“A cop was killed and four cops injured, breaking down a door of a drug user, just this week in New Hampshire,” he said. “People die … and it’s not the drugs that are killing them, mostly, certainly not pot killing them, it’s drug laws that kill.”</p>
<p>Paul – and others – proceeded to light joints in the street before marching to the steps of the Statehouse to talk more, sing songs, and at 4:20 p.m., smoke more marijuana. They then headed into the Hall of Flags to sing more songs – replacing the lyrics to Christmas carols with anti-drug war lyrics – and even gave some guards and state troopers hugs.</p>
<p>State Rep. Mark Warden, R-Goffstown, was the only representative or elected official in attendance at the rally. He is a sponsor of marijuana bill before the House that would lower the penalty for a small amount of marijuana from a misdemeanor to a violation.</p>
<p>When asked how he and others could mobilize voters like those smoking pot and having a merry old time at the Statehouse to work to implement change, Warden said it took one-on-one meetings and data to convince his colleagues.</p>
<p>“One of the things I try to do is find common ground with somebody who is a single issue voter and then work the liberty angle on something else,” he said.</p>
<p>Today, it might be marijuana, he said, another day, it might be guns, the budget, or individual rights. Warden said he was using the existing infrastructure like NORML to press the bill’s merits and work to breakdown the “long-standing prejudice against marijuana” at the Statehouse.</p>
<p>The group hopes to hold another rally at the Statehouse on Nov. 5, a day before the presidential election.</p></blockquote>

<blockquote><p> Yesterday I had the pleasure of joining Kelly Voluntaryist, Ian Freeman, Darryl Perry, Jason Repsher, Rich Paul Freeman, and over a hundred other activists for the 4/20 rally, at the State House in Concord, NH.</p>
<p>Activists from Keene, NH met at the Keene Activist Center, as we so often do, a week in advance and discussed what we would do, who wanted to go, and who could provide transportation, signs were made, channels for two way radio communications were decided on, and by the time we loaded into our cars, everything was ready to go. Other activists from across the state and political spectrum also made plans and attended.</p>
<p>Some people had arrived early, to clean up the streets. Liberty activists performed a litter pickup, as agents of The State wrote parking tickets nearby&#8230; <span id="more-17174"></span></p>
<p>As we arrived, there were about a hundred people there already, holding signs, smoking weed, and making new friends, just a few feet from where the New Hampshire legislature meets to conspire against them. I was happy to see that a number of parents had brought their children, in hopes they might grow up in a freeer society than they had the opportunity to grow up in. The case for spontaneous order was made no better than by one such parent suggesting that anyone smoking (legal or otherwise), do so on one side of the rally so that parents could keep their children away from the smoke on the other, nobody needed to be coerced, threatened, berated, assaulted, kidnapped or robbed (as The State so incorrectly believes is necessary for order) they were more than happy to respect the wishes of the young mother. </p>
<p>Up to this point we had been on the sidewalk outside the building, we heard a few inspiring words by several speakers, before Rich Paul Freeman asked if we were ready to take the steps, to which I loudly yelled &#8220;Yeah!&#8221;. Perhaps a bit unsure as to whether the rest of the crowd heard him, Rich asked again, and the crowd this time responded in kind, and we crossed through the gate onto the lawn of the State House and made our way up to the steps, just outside the front entrance, where police where inside waiting. </p>
<p>This didn&#8217;t stop us from lighting up joints and pipes right in front of them. If you know me, you know I&#8217;m not much of a pot smoker, but on this day, I simply couldn&#8217;t resist the opportunity to smoke up on the steps of the State House with my fellow freedom fighters. I was reminded quickly why I stopped smoking pot, as cotton mouth and the inability to concentrate or communicate set in&#8230; </p>
<p>Keene activists came with an abundance of propaganda, handing pamphlets out to the people who came, but might not have had a full grasp of what it really means to be free, information on jury nullification, &#8220;Never Take A Plea&#8221;, and voluntary solutions to societies ills were warmly received by people who had perhaps come simply thinking that medical marijuana should be decriminalized.</p>
<p>Ian Freeman held the attention of the crowd as if they had all paid to see him, he spoke charismatically about the bigger picture and what people could do to make things better, it was obvious he was making people think. When one bullhorn failed, we had another ready to keep the action going.</p>
<p>A paper was handed out containing Christmas Parody songs written by Richard Onley, and the Shire Chior was formed. Outside we sang to the tune of &#8220;Santa Clause is Coming to Town&#8221; a powerful parody called &#8220;Drug War Cops are Raiding the School&#8221;</p>
<p>And you know, that was a lot of fun. It was so much fun, that Ian suggested, maybe we should go inside the State House and do it! Ian opened up the door and I followed Kelly Voluntaryist inside. The police asked us to be quiet, and Kelly assured them quote &#8220;I&#8217;ll see what I can do about that&#8221;, dozens of people entered the lobby of the building and formed a circle, where we performed such classics as &#8220;Hands off Weed-a-claus&#8221; &#8220;War on Drugs&#8221; &#8220;A Lay of Anslinger&#8221; and &#8220;Violent Blight&#8221;, along with another round of &#8220;Drug War Cops are Raiding the School&#8221;.</p>
<p>Certainly the dozens of voices enthusiastically belting out anti government propaganda songs was not what the police would have defined as quiet, but for that handful of cops to drive off that many activists would have been quite a task, and so they endured our display throughout the duration, after which, Ian encouraged everybody to hug the police on their way out, and several people did.</p>
<p>To some of the people tagged, none of this is news, they were there&#8230; For others who may be reading, I have 3 words.</p>
<p>MOVE TO KEENE!</p>
<p>Well, if you&#8217;re set on a solution that involves a compulsory government of any sort, then you might be better off in Nashua or Manchester or something, but you should still come to New Hampshire.</p>
<p>If you&#8217;re ready to stop asking permission to be free, if you&#8217;re ready to renounce initiatory force as a valid method of problem solving, if you&#8217;re ready to meet awesome people and be surrounded by people who know how you feel, then don&#8217;t waste any more time swimming against the tide.</p>
<p>It is entirely possible, and even likely, that your state is too far gone. The only chance I see for us to be a free people is to be in one place, and make it ungovernable by rejecting their authority and supporting eachother in so doing. The infrastructure for a free society is here, you are all that is missing. Once you move, that will serve as encouragement for others to move, when they move, the same process occurs, and this can grow exponentially. And hey, even if it doesn&#8217;t, there is still no state income or sales tax, and you can still get a concealed carry permit for $10&#8230; </p>
<p>Flee your oppressive governments, as I did. Come here with resources to get you by for at least 3 months while you look for work. Know Freedom, or No Freedom, you decide.

The <a href="http://shirechoir.fr33agents.com/">Shire Choir</a> performed several &#8220;<a href="http://freekeene.com/2011/12/01/download-your-chronic-carols-songsheet-2/">Chronic Carols</a>&#8221; inside the state house, while plenty of cannabis was smoked in front of the building as state police looked on.  Thanks to the police for doing the right thing and standing down and allowing peaceful people to be free.</p>

<p>The costumed men, habitual threats levied, ridiculous formal rituals, and attempts to force me to respect a system I abhor is enough to drive me crazy.  It doesn&#8217;t because I don&#8217;t allow it to, because if it does they are winning and we all know I don&#8217;t want that!  However, I must admit it is taking up a certain amount of my time and, worse, my energy.  Legal land sucks.  It truly is the worst part of civil disobedience.  Every action has an equal and opposite reaction, and I choose to live free with the knowledge that, in one way or another, I will pay the price.</p>
<p><span id="more-17134"></span></p>
<p>My recent legal adventures to which I&#8217;m referring are related to my <a title="Three Arrests for Trespassing at Keene Superior Court" href="http://freekeene.com/2012/02/28/three-arrests-for-trespassing-at-keene-superior-court/">trespass arrest </a>on February 27th, when I was arrested for &#8220;trespassing&#8221; at Cheshire County &#8220;superior&#8221; court with Ian and Derrick J.  Our court date, originally scheduled for April 17th, was continued due to motions filed by both Derrick and David Lauren, the individual representing &#8220;the state&#8221; in our persecution&#8230;er, I mean, prosecution.  Anyways, the state was intending to try us all at once, but Derrick is in the process of <a title="Non-Violent Communication with Prosecutors" href="http://freekeene.com/2012/04/17/non-violent-communication-with-prosecutors/">plea negotiations</a> for his victimless crime spree and most likely will not be tried with Ian and I.  Additionally, David Lauren claimed to want to continue the trial because he supposedly has some new video evidence (likely our own videos) having to do with the fact that we were served with some paperwork, which is just silly as no one from either side is disputing that fact.  Yawn.</p>
<p>So here&#8217;s the bottomline: The prosecutor&#8217;s office has also filed a motion to have our charges dropped from class A misdemeanors to class B misdemeanors.  The charges against me are criminal trespass and breach of bail.  Charged as class A, in combination they are punishable by up to two years in the cage, as class B they are punishable by up to a $2400 fine (again, combined), which translates to 48 days in the cage at $50 a day since I will sit in a cage rather than pay to support this system of violence imposed upon me.   Charged as class A, I am eligible for jury trial.  As class B, my case will be held in front of Burke, who I&#8217;ve been actively <a title="Impeach Burke Rally Video" href="http://freekeene.com/2012/04/13/impeach-burke-rally-video/">campaigning to impeach</a>.</p>
<p>I could potentially win in front of a jury.  Burke will almost certainly find me guilty.</p>
<p>David Lauren claimed that he filed the motion to have the charges reduced from class A to class B because he felt it was more appropriate to the facts of the case, and expects us to feel grateful as it carries a much lower potential sentence.  However, Ian is not at all grateful and actually filed a counter motion to have his charge tried as a class A in front of a jury.  Nor do I feel particularly grateful for thrown crumbs, and a big part of me wants to do the same.  Act on principle, stand behind my actions and let the cards fall as they may.  Roll the dice.  The inherent personal risk is serious, but it&#8217;s the right thing to do&#8230;.or is it?  How much risk am I willing to take for my principles?</p>
<p>To complicate matters further, the persecutor then offered a deal where he would drop the criminal trespass to a simple violation and drop the breach of bail charge entirely, in exchange for my plea of guilty.  My punishment would consist of a $500 fine, equal to ten days in jail.  I would be completely finished with this case and could move on to whatever the future might hold.  I could be free to do more civil disobedience.  Unfortunately, I don&#8217;t think I could freely sleep at night knowing that I bowed to Leviathan.</p>
<p>To be an effective activist, one must be consistent, and it has been proven time and time again that the longevity of civil disobedience activists is directly related to their ability to avoid being completely crushed by the state.  If I were to lose at jury trial, I would most likely not only be caged for several months, but my activism afterwards would be bound by the overriding threat of an even longer suspended sentence if I were to be arrested again within whatever arbitrary period of time the court decided to impose.  Is it worth the risk?  Don&#8217;t I owe it to this movement to extend my longevity as an activist as far as possible?  Don&#8217;t I owe it to myself to stand for what is right?  Or is it the other way around?</p>
<p>I hate legal land.  I hate the constant attack on my principles, and I hate the fact that the threat of violence still makes even me question myself.</p>
<p>I have much to think about.</p>
