<blockquote><p>WASHINGTON—Striking down the judicial precedent that established the legal supremacy of right over wrong more than two centuries ago, the U.S. Supreme Court on Wednesday overturned <em>Right v. Wrong.</em></p>
<p>The landmark reversal—a bitterly contested 5-4 decision that has been widely praised by murderers, rapists, bigots, usurers, and pro-wrong advocates nationwide—nullifies all previously lawful forms of right and makes it very difficult for Americans to make ethical decisions or be generally decent human beings without facing criminal charges.<span id="more-14826"></span></p>
<p>&#8220;It is the opinion of this court that the Constitution was crafted in such a manner as to uphold and encourage practices that are not right and, ideally, are very wrong,&#8221; Justice Antonin Scalia wrote for the majority, which also in­cluded Justices Clarence Thomas, Samuel Alito, Anthony Kennedy, and John Roberts. &#8220;Despite the compelling case for goodness, truth, and justice made by our predecessors in the case of <em>Right v. Wrong</em>, we firmly believe that malice, dishonesty, and injustice were the framers&#8217; original intent.&#8221;</p>
<p>&#8220;The ruling today rights an age-old wrong in which right has consistently, and unconstitutionally, prevailed,&#8221; Justice Alito wrote in a concurring opinion, adding that the decision between right and wrong did not present a difficult choice for him. &#8220;It is clear the earlier court erred when issuing the<em> Right </em>decision.&#8221;</p>
<p>The ruling in<em> Right v. Wrong</em> was handed down in 1790 by the Supreme Court&#8217;s six original members, all of whom sided with the plaintiff, prompting Chief Justice John Jay to write, &#8220;It is the emphatic province and duty of this highest judicial tribunal to rule in favor of Right, as the argument in support of Right is the right one, and the argument in support of Wrong is the wrong one.&#8221;</p>
<p>Since that time, the verdict has been cited in most legal rulings at the state and federal level, and has been upheld by the Supreme Court numerous times, most notably in a 1974 opinion overturning a Six Circuit Court of Appeals decision that would have re-segregated the nation&#8217;s schools, abolished the minimum wage, legalized evil, and allowed law enforcement officials to conduct searches and seizures without a warrant.</p>
<p>This term, the high court agreed to hear the appeal of an Arizona state judge&#8217;s ruling for the defendant in the case of <em>Good v. Bad</em>, a decision that had once more called into question the basic tenets of <em>Right v. Wrong</em>.</p>
<p>&#8220;If you look at the current makeup of the court, the verdict is hardly surprising,&#8221; said law professor Erwin Chemerinsky, adding that given recent decisions to permit unlimited corporate spending in electoral politics, crack down on civil liberties, and allow the execution of Troy Davis to proceed, he believed the justices had been angling to do away with <em>Right</em> for some time. &#8220;It&#8217;s long been clear Roberts and Alito were in the camp favoring wrong, and Scalia&#8217;s passionate criticism of the <em>Right</em> decision almost certainly swayed Justice Kennedy.&#8221;</p>
<p>&#8220;As for Justice Thomas, he was practically asleep when the attorneys representing Good gave their oral arguments,&#8221; Chemerinsky added. &#8220;In terms of his job, that was definitely the wrong thing to do, so he made it pretty clear which side he was on.&#8221;</p>
<p>Many constitutional scholars have argued the ruling sets a dangerous precedent whereby violent criminals could conceivably appeal their convictions and, citing the federal judiciary&#8217;s rejection of <em>Right</em>, be acquitted of their crimes.</p>
<p>According to reports, the impact of the verdict has already been felt, with a Massachusetts man murdering three people this morning in front of several Boston police officers who by law could do nothing but watch. In addition, a woman who volunteered at a Toledo, OH soup kitchen has been arrested, sentenced to six months in jail, and fined $25,000.</p>
<p>&#8220;This ruling is so broad that even those who show an<em> intent</em> to do right can be prosecuted,&#8221; said Martha Minow, dean of Harvard Law School. &#8220;Make no mistake, the court is sending a message to pro-right supporters that fairness and equality are no longer the laws of the land. And the decision has no chance of being overturned in the immediate future, because the bench will be dominated by pro-wrong advocates for years to come.&#8221;</p>
<p>Justice Stephen Breyer chose to read his dissenting opinion aloud before the court, a rare gesture apparently aimed at expressing the full measure of his disgust with the verdict.</p>
<p>&#8220;The court needs to overturn this ruling immediately because, simply put, it&#8217;s the right thing to do,&#8221; said the associate justice, who,  along with his colleagues joining him in the minority, was then arrested by Capitol Police, placed into custody, and is currently awaiting trial.<img src="http://o.onionstatic.com/img/icons/terminator.gif" alt="" /> &#8211; <a href="http://www.theonion.com/articles/supreme-court-overturns-right-v-wrong,27077/" target="_blank"><em>Supreme Court Overturns Right v. <p>We laugh only because the joke rings so true.</p>
<p>The corrupt system of corporatism (fascism) that we have on our hands in America today is making it quite difficult for me, as an American, to do the right thing.  <a title="Kelly v. the TSA – Don’t Strip Our Rights -Thursday Feb. 2" href="http://freekeene.com/2012/01/27/dontstripourrights/" target="_blank">Tomorrow morning</a>, I face the possibility of being tossed in a cage for peacefully exercising my so-called Constitutional right to proper redress of grievance<strong>, </strong>standing up for the rights of myself and others, and doing the right thing.</p>
<p>Perhaps fairness and equality are no longer the laws of the land, but they are still the laws of the universe and of nature.  I am quite certain that the scales of justice will tip even in the end.  I&#8217;m not hurting anyone and I&#8217;m doing the right thing, thus my conscience is clear.</p>

<p>I was pulled over while driving 50 mph in a 55 mph zone. The officer alleges I was going 72. That is impossible because I was stuck behind a slow-moving pickup truck for about 20 miles, and that truck was keeping me slowed at a pace of 50 mph.</p>

<p>I was driving from Keene to Manchester with Luthor Kingsley of the Shire.  We were about halfway there when I passed a cop.  Luthor pointed him out; he was hiding on the side of the highway with his lights off.  I checked my speed and was relieved to notice that I was going 50mph.  I almost certainly would have been going faster if not for the truck in front of me holding me up in the single lane of traffic.  Then I saw the blue lights behind me.  I fired up my camera and asked Luthor to record.  </p>
<p>The cop told me I couldn&#8217;t see the radar, that Luthor had to turn off the audio on the camera, that Luthor had to give the cop his ID, and that it was illegal wiretapping to record audio of him without his permission.  We gave him a bit of a schooling in the law with polite refusal to comply with his demands.  He returned with a <a href="http://www.scribd.com/doc/79819899/72-in-55-Ticket-1-28-2012-edit" target="_blank">ticket for $103.33</a>.  </p>
<p>I&#8217;ll be seeing him in court.  I would rather be left alone.  I don&#8217;t enjoy giving up my valuable time and energy and resources to defend myself against being extorted by agents of the state.  I&#8217;ve already spent about 24 hours in filming, editing, researching law, and posting about this event.  Now I&#8217;ll have a day in court, travel expenses, plus the opportunity costs of a day&#8217;s work in order to attend court, or I will have a warrant out for my arrest.  Then, in court, if I am found guilty, I will likely face 2 days in jail to pay off the fine at $50 a day.  </p>
<p>Some stranger with a badge is incentivized by a quota system to spend his time pulling over people like me who haven&#8217;t victimized anyone.  For him, it&#8217;s 15 minutes and he can wash his hands of the situation and collect his paycheck&#8211;unless someone takes the issue to court rather than paying the fine.  In that case, he is rewarded for his victimization by being paid time and a half for his appearance in court.  The taxpayers of his town will be forced to foot the bill for that expense.  As a result of his actions, I could be put in a cage (again at the expense of the taxpayer) for what was a non-situation.</p>

			<content:encoded><![CDATA[<p>In a press release today titled &#8220;<a href="http://www.governor.nh.gov/media/news/2012/010312-no-guns-dorms.htm">No Guns in Classrooms or Dorms</a>&#8220;, Governor John Lynch returns <a href="http://www.nashuatelegraph.com/news/931352-196/area-police-governor-decry-deadly-force-bill.html">to the same fear mongering tactics</a> he and high-ranking police administrators used throughout the state when they vehemently opposed the modification to the deadly force law which now doesn&#8217;t require you to turn and run when your life is in jeopardy.  </p>
<p>Oh, the New Hampshire General Court utterly ignored the Governor and his law enforcement contingent and <a href="http://merrimack.patch.com/articles/nh-expands-deadly-force-law">passed that bill</a>.  There hasn&#8217;t been any random killings in the street like they tried to have you believe, either.  </p>
<p>Well done NH House of Representatives and NH Senate.  Let&#8217;s see you do it again!</p>
<p>From today&#8217;s most recent tirade:</p>

CONCORD – Law enforcement and higher education officials from across New Hampshire today called on the House to reject a bill that would allow guns in college classrooms, dorms, libraries and across public higher education campuses. House bill 334 is one of three the House could possibly take action on as early tomorrow that will severely weaken New Hampshire&#8217;s decades-old gun laws <strong>and potentially put public safety at risk.</strong>
</p></blockquote>
<p>Wrong, politicians like you and your law enforcement/USNH cadre put public safety at risk, Governor Lynch.  All of these regulations only hurt the people who would never hurt someone in the first place.  In Utah and Oregon carrying firearms is specifically allowed on campuses like ours.  I&#8217;ve been waiting for you or the University System of New Hampshire to come up with some examples of how enhancing self-defense freedoms for peaceful people out west has been a disaster of a public policy change.  I&#8217;ve heard crickets.</p>
<p>Amazing that this simple logic doesn&#8217;t get through to these people.</p>
<p>Not that the Governor and his law enforcement supporters care about the oath they took, but Part I Article 2-a of the New Hampshire Constitution says: </p>
<p>&#8220;<strong>All persons have the right to keep and bear arms in defense of themselves, their families, their property and the state.</strong>&#8221;  </p>
<p>I guess by &#8220;all persons&#8221; it really means &#8220;all people except if you are a college student, because if you&#8217;re a college student you need to be treated like a child.&#8221;</p>

			<content:encoded><![CDATA[<p>This past Friday Pete Eyre, fellow CopBlocker and FreeKeene.com blogger, and I went to Plymouth State University to cover the gun protest put on by former police officer, Brad Jardis. While there I spotted an individual who seemed a bit out of place. Turns out he was an undercover police officer. </p>
<p>Pete also interviewed several cops present about the double standard they were displaying by carrying firearms to protect people but using those same guns against someone who decided to do the same. Below is that video:</p>

			<content:encoded><![CDATA[<p>Regarding my <a href="http://freekeene.com/2011/11/30/the-university-system-of-new-hampshires-illegal-victim-disarmament-zones/">blog</a> on 12/02/11 regarding the University System of New Hampshire illegally enforcing a firearm and knife ban, I recently was contacted by a government official who suggested I make you aware that quite openly in the media the University System of New Hampshire is claiming that they HAVE the authority to do what state law pretty clearly says they do not.  </p>
<p><em>&#8220;New Hampshire is one of 25 states that allow individual campuses to set their own rules on weapons, though the policies are close to identical. All of the campuses ban firearms and most other weapons, and that&#8217;s the way education officials want it to stay.&#8221;</em></p>
<p>Incorrect.  No political subdivision can regulate knives or firearms without the express permission of the NH General Court. </p>
<p><em>&#8220;Private businesses can put in place any rules about firearms they want, &#8220;<strong>but as long as UNH receives taxpayer money, they are a subdivision of the state and they are completely disregarding the law</strong>,&#8221; said Republican state Rep. J.R. Hoell of Dunbarton.</em></p>

<p>It has been several months since I contributed to the Free Keene blog regarding my transition to liberty or my opinions about stuff that is happening in the government world. In fact, my second to last post here was about how I, for the first time in 30 years crawling this planet, got arrested.  I was arrested at the US/Mexico border in Nogales, AZ by United States Customs and Border Protection for exercising the 5th Amendment.</p>
<p>My blog was titled &#8220;<a href="http://freekeene.com/2011/07/05/i-sat-in-a-cage-to-defend-the-5th-amendment/">I Sat in a Cage to Defend the 5th Amendment</a>.&#8221;</p>
<p>Well, I finally got my &#8220;arrest report&#8221; from the feds (after 4-5 months of notarizing forms, mailing things back and forth, and begging) and it sure looks like they let me off easy for the pure evil I unleashed at the border station. It looks like I misled you in my July blog in that that I failed to mention that I, according to the federal officer who arrested me, murdered one of their co-workers.</p>
<p>Among the two things I &#8220;could have been arrested&#8221; for were 18 USC 111 and 18 USC 1114. That would be <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00000111----000-.html">forcibly impeding</a> and <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00001114----000-.html"><strong>murdering</strong> a federal officer</a>. Now verbal warnings are given out every day for things like speeding and rolling through a stop sign&#8230; but I never imagined I&#8217;d get a verbal warning for violating a law that I could get the federal death penalty for. I went straight from never having been arrested or convicted of anything to the lethal injection.</p>
<p>Here&#8217;s <a title="report" href="http://www.freeimagehosting.net/6971b">the report</a>.  It is so ridiculous, I believe it deserved its own meme.</p>
<p>Now, having written a police report or two myself, I&#8217;ll point some things out that are happening in CBP Officer Aldrich&#8217;s weak attempt of a report he came up with.</p>
<p><span id="more-12635"></span></p>
<p><strong>1) It conveniently omits the fact that he grabbed me by the arm approximately 10-seconds once I was in the inspection line and refused to answer his questions.</strong></p>
<p>Using physical force to effect a detention alone can constitute an arrest, and in my opinion in this situation, it did.  For a person to be arrested they don&#8217;t need to be told &#8220;you&#8217;re under arrest,&#8221; it hinges on the totality of the circumstances in each particular situation.  You could be &#8220;under arrest&#8221; if the police tell you to sit on a curb for an extended period of time.</p>
<p><strong>2) It conveniently omits the fact that I was handcuffed.</strong></p>
<p>Why would CBP Officer Aldrich leave out the fact that I was handcuffed?  Well, because handcuffing someone during a customs/immigration &#8220;inspection&#8221; surely proves the escalation from an &#8220;inspection&#8221; related detention (that CBP has the authority to do) to a full-blown criminal &#8220;arrest.&#8221;  I was unequivocally told &#8220;you&#8217;re under arrest&#8221; and CBP Officer Aldrich&#8217;s omission of this critical fact is, in my view, a purposeful lie.</p>
<p><strong>3) It takes a personal jab at me:</strong></p>
<p>I do take medication for depression and anxiety.  So do 27+ million Americans.</p>
<p>Truth is, I did nothing wrong.  He needed some sort of &#8220;negative&#8221; to put in the report about me.</p>
<p><strong>4) CBP Officer Aldrich&#8217;s use of the word &#8220;inspection&#8221; at the end of the report:</strong></p>
<p>This is another failed attempt to attempt to rewrite history of this incident. CBP Officer Alrdich wants history to reflect this incident to be a routine &#8220;inspection&#8221; when in fact he actually made a full-blown criminal arrest.  I am sure he is violating some DHS/ICE/CBP policy for failing to properly report on an arrest&#8230; or possibly even filing an intentionally misleading report.</p>
<p>So that&#8217;s my update in my quest to get the federal officials at the border to respect the 5th Amendment. I am represented by a civil rights attorney to whom I was referred to by none other than the amazing Ernest Hancock of <a href="http://www.freedomsphoenix.com/Front-Page.htm">Freedom&#8217;s Phoenix</a>.  I&#8217;ll have a copy of the federal civil rights lawsuit posted here in .PDF format as soon as it files.</p>
<p>You&#8217;d better believe I will be flying to Arizona personally to take part in the depositions. I want to ask questions myself&#8230;  I&#8217;ve already got 34 ready.</p>
<p><strong>UPDATE</strong>: The Nomad Lawyer&#8217;s blog (a great blog in itself, I highly recommend it) <a href="http://nomadlaw.com/2010/09/10-brief-responses-700-comments-about-refusing-answer-questions-at-passport-control/">has ten great responses</a> to why people shouldn&#8217;t answer questions at passport control.  I confer extensive credit to Attorney Lukacs&#8217; blog for educating me on the legality of standing up for the Constitution at the border.</p>
