Judges Ruling: Darryl W. Perry vs City of Keene, et al.

I’ve been waiting to make this post, partly because I wanted to make sure it would be the final post about the case.
A Lady Judge, whose name I don’t remember and can’t make out, dismissed the case. It was dismissed after the Hearing on the Motion to Dismiss because the court claims I supposedly “failed to state a claim upon which relief may be granted.” The Judge did not adress the immunity claimed by the defense, nor did she mention Article 10 which states there are not to be two classes of men.

The order does not specify whether or not I am being ordered to pay attorney fees for the defense, and no further order has been sent. For the past two weeks, I’ve been debating about whether or not to file an appeal to the NH Supreme Court. I have decided against doing so, as the Supreme Court likely would not rule on the Article 10 arguments brought forth in my case in motions and responses to motions.
