Heika Arrested for Using Megaphone

I arrived on-scene as Heika was being loaded up into a KPD cruiser. Her crime? “Free” speech over a megaphone. We were kicked out of the court earlier by the robed man because a bunch of activists stood for Rich Paul when he was called. It was because we were kicked out of court that Monica went to get the megaphone – I had run home at this time to make a phone call I was late for, and when I returned, Heika was being arrested for “disorderly conduct”. According to witnesses, Heika was not on the megaphone when police arrived. They didn’t give her a warning that she was being “disorderly” – they just came up and arrested her. They are calling it a bail violation, so she’s in jail at least for the night and the arraignment is expected for tomorrow. Hopefully she won’t lose her job. :(

    Fighting this one in the system won’t work, I don’t think.

    Chances are they’re charging she disrupted the orderly flow of business in a government building.

    You can probably call the judge as a witness though :D

    I dispute the constitutionality of a judge clearing the courtroom for the act of standing.

    I bet the charges will be dropped. They probably just arrested her to shut her up for the day. It’s not like there will be any consequences for kidnapping her for a night.

    While the arrest and charge are bogus (not proportional to the claimed offense) the request to stop using the bullhorn is not anything to oppose IMO. Sound can certainly be considered a pollutant. It’s transient and not likely to result in long term property damage but fundamentally only a difference of degrees from any other pollutant. The freedom of speech even on government owned property ends where someone else’s private property begins just as if it was originating on private land.

    I love what Rich Paul and Heika are doing. But bullhorns are bullshit. I, for one, won’t be attending any mass demonstrations where bullhorns are being used for the simple reason that they are annoying. I don’t know if there is any private property in the vicinity of where Heika was making noise today, but if there were, then a complaint is justified in my opinion. And I do agree with the statement above. Noise can be a pollutant.

    Seth, I agree. I find bullhorns abrasive and based on my observations the general public feels the same way. Therefore it seems like a poor strategy for outreach regardless of the property implications. As Varrin did well in his letter to the editor, it should be pointed out that so called public property has major issues, however we should be acting on that public property not too different from if it were private property.

    Just because Peloquin CAN fly it solo, doesn’t mean things wouldn’t have gone smoother if he’d had a dedicated wingman. But sending HOTHEADdeskjockey Rivera out in a suit to spout FELONY threats is like tossing gasoline on a fire…Field Captain must be BROWN-nosing again…Maybe KPD forgot to feed their CI’s again…CONGRESS INSISTS on better action, kids…Uncle Sam is WATCHING you!…EITHER McLauglin coulda’ done better…If you’re charging felony, it’s going County, anyway…anyway…anyway…

    Well, it sounds like he surely will be a witness in the criminal case.

    I think that judges probably can find someone with a megaphone in common law criminal contempt for disrupting judicial proceedings… even if the disruption is made outside of the courtroom. As this sounds like a case brought by the state of violation of a criminal law… the judge is the complaining victim.

    Lance/Andrew…. any thoughts on that?

He'll eat *ANYTHING*"???…Their usual MO is when Rivera screws the pooch, *AGAIN*, they just toss it back in ROBEDMAN's lap, & he screams *CONTEMPT*…Hard to *APPEAL* a "contempt" ruling…Since Burke has been in bench, "Contempt" has mushroomed in the Court reports…Veteran Court Reporters know that the less competent a judge is, the faster, & more often, will they scream, "Contempt!"…Burke couldn't hold Court proper in the Bar, if YOU bought HIM drinks…it's why my court motto is NEVER AGAIN! As for putting out fire with gasoline: FUCK YOU, BURKE! at least Lane, jr., has *SOME* judicial temperment, even if he's a sloppier dresser…(I hate bullhorns, too, but still…..c'est la vie…When Talbot was on the bench, at least he kept court running smoothly.     For a hundred dollars or less, a city permit to pedal ice-cream in a truck, could be had. OK, with insurance and the rest of it, maybe a few grand. Park the thing all day, everyday in front of the courthouse, playing that god awful Da-Da—Da, Da …. music. Maintain perfect legality. Nice clubhouse, sell ice-cream. Keep warm for 4-20. Munchies! Topless Tuesdays well into the Autumn. Money on the side. In January, the density of cold dense air allows the sound to travel far and wide.

    It’s win-win, although the robed man might wish for a megaphone.

He prolly meant “Field Operations Captain”, who is the Supervisor below Meola level responsible for herding cats. “BROWN-nosing” prolly is a reference to what happens when your loyalty and years of service are ignored at Promotion Time, and HIGHER POWERS steal your thunder. Yes, Keene Native Timothy Peloquin, a near-retirement Veteran street-walker/beat-walker is the star of the video. He’s good enough to do the work of 3 or 4 cops all by himself, which partially explains his size, but doesn’t explain why the City Council makes his paycheck about 1/2 or even less the size it SHOULD be. “Talbot” must mean retired judge Richard Talbot, who was an amazingly competent and fair jurist. Talbot always ran a smooth courtroom, but “Burke-the-jerk” just wouldn’t follow master Talbot, which mostly explains why “Keene District Court” went down the toilet faster than yesterdays beans & corn. That should answer your questions. If I left anybody out, they aren’t worth mentioning. Some shit just stinks too much to talk about. P.S.: Megaphones aren’t illegal in NH, same as guns. But assaulting flesh or sensibilities with bullets or bullhorns CAN be charged as a crime. Unless one has a speech disability, and requires the reasonable accomodation of a bullhorn to be heard. OK?     Like Heika, I suppose you can say that I’ve been “brainwashed” by these “fools.” I am now one of them.

    I’d actually call what I’ve (and Heika) learned is reverse brainwashing. The things that I, you, and Heika were taught in school about how the government operates traded away our individual moral compasses for the decisions of the majority.

    What Heika is doing (and what I am doing) is standing up to the same corrupt system that enacted chattel slavery, enforced Jim Crow laws, and currently sends countless human beings to be caged like animals for doing trivial things that don’t harm anyone else.

    Emshell, do you realize that the way you are responding to someone putting their freedom on the line to combat the depredations of the state is the same way that many people before you have responded towards people who advocate less tyranny and more freedom?

    Please ask yourself if you would have calling the protesters in the civil-rights era “brain washed fools” for daring stand up to the leviathan that does so much damage?

    I am sure there are dozens of police officers working today that, when asked, say they NEVER would have enforced laws that prevented black people from drinking out of white water fountains… or laws that allowed other human beings to own someone simply because their skin was pigmented.

    The funny thing is… these people (and possibly you) who claim that they would have neither supported or enforced the tyranny of the past are the PRECISE people who would have. How do I know this? Because these people (you…) are doing the same thing NOW.

    Were I a police officer back in the 1960′s I never would have enforced the sick Jim Crow laws. Were I a federal agent back in the 1800′s I never would have enforced the sick slave laws. How do I know this?

    Because I refuse to enforce the sick tyrannical laws of today.

    I don’t live in Keene and haven’t been able to do much other than contribute by writing right now. I’m dealing with some pretty awful health issues right now. Google “effexor withdrawal” if you’re interested… if you’re capable of having understanding or compassion for a human being that is having a hard time.

    To be honest with you, I’ve thought a lot about being in jail. If I end up there hopefully you’d realize that I’d be there because I wanted to be. I’m not afraid of being in “GP” … for if I was, I’d be honest with everyone there about my past, apologize for what I’ve done, and try to help people understand how I’ve traded in my free-pass on using violence on peaceful people for the harder road of trying to stop violence.

    Would I get hurt? Maybe. I’ve hurt quite a few people after eleven years in law enforcment… and I’m a believer in Karma.
