As you may recall, the “City of Keene’s” illegal case against Free Keene blogger and NH native Graham Colson was nearly dismissed from Keene district court, but judge Burke allowed a few days for “the city” to file a motion to reconsider, which they did.
Heroic free speech attorney Jon Meyer (who is taking this case pro-bono) filed this response and Burke subsequently denied “the City’s” motion to reconsider and dismissed the case!
To recap, attorney Meyer had argued that banning Graham from Central Square for skateboarding – without first trying and convicting him of such – was illegal and in violation of due process and separation of powers. Here’s a longer article about that argument.
So, again, the people calling themselves “the City of Keene” have now lost multiple cases against local activists, at who knows what cost to the taxpayers. They lost the trespassing and smoke alarm cases against me, the Robin Hood case, and now their no-trespass orders at Central Sq. have been smacked down by judge Burke. Kudos to Burke for making the right decision again!
i’m sure i could have gotten the no-trespassing order against me (saying i wasn’t allowed at the jail) dismissed, but i didn’t bother going to court about it. i had never been tried or found guilty of anything that would have gotten me banned from the jail (i hadn’t even been to the jail… the order was made by VanWickler based on a facebook message i sent him, requesting he release the people that were arrested for “trespassing” at the jail). also, the order was for “meg mclain” which is not my legal name. they are just grasping at straws,… Read more »
Hurray.
Another example of systematic and repeated civil rights violations by the city committed against their perceived political enemies.
On the taxpayer’s dime.
So how many wins now for Jon Meyer? And how many wins for Marc Stevens? I think you now see the proper path to fight.
Highly suggest a FOIA request from the city of Keene demanding detailed expenditures relating to these legal suits against peaceful citizens expressing their rights and/or being targeted for their political views and/or actions. Then add that information to the RobinHood pamphlets being distributed and make handouts to be distributed at every public meeting in the city DEMANDING Accountability for this reprehensible behaviour by the elected (and unelected) people calling themselves the “City of Keene”.
Go Jon Meyer!
