A Keene-area state representative laments the fact that, “there is, legally, nothing we can do to prevent them from moving here to take over the state, which is their openly stated goal.” The Other; “them” in this instance refers to participants in the Free State Project, the political migration of liberty minded people to NH. Though the FSP has no central direction and amounts to little more than a promise to move together with like-minded others, freshly elected representative Cynthia Chase has classified her new neighbors as a threat. In this country you can move anywhere you choose and they have that same right. What we can do is to make the environment here so unwelcoming that some will choose not to come, and some may actually leave. One way is to pass measures that will restrict the ‘freedoms’ that they think they will find here.
One wonders how Ms. Chase plans to make the state “so unwelcoming” for libertarians in such a way that would not be unwelcoming to others. She tips her hand by opening in regret that political purges are illegal, but then suggests that she and her ilk can try.
Santa Claus, also known by his friends as James Peterson, was arrested after spreading holiday cheer and chalk with young people in front of the Texas capitol building on the 21st. An occupy activist who was giving out chalk to children while dressed as Santa was well received in the plaza, but as he left, Texas DPS officers chased him down and handcuffed him. The crowd appears shocked, one woman yelling out in confusion, “You’re arresting Santa Claus?!”
The jolly red man asks numerous times, “Why am I being arrested?” After a minute, they tell him that he was chalking the sidewalk. A few in the crowd having filmed the entire time tell police that everyone was chalking, to which a female officer states, “You’re the only report that we got of chalking.” (more…)
It comes as a modest victory that the case of State v Garret Ean, relative to a bicycle headlamp violation dating back to June 2011, was closed without a guilty finding on December 18. Judge M. Kristin Spath issued the order which I received on the 20th stating that, “The court is using its discretion pursuant to RSA 262:42 and placing this complaint on file without a finding for a period of six months…” This ‘neither guilty nor not-guilty’ ruling is a legislative creation for New Hampshire courts which reads, “A complaint against a person…may be placed on file at the discretion of the court, if the violation appears to have been unintentional, or if no person or property could have been endangered thereby.” This provision applies most to the ambiguous motor vehicle statutes and some other infractions that do not fall under the more straightforward criminal code. While I complete a summary article on the entire court performance, here is a brief history of the case chronicled with court documents.
The first court appearance I had for this incident was in September 2011, when I received discovery from the state and traded with them my evidence and witness list. The case was continued a number of times while my witness was traveling. When a date of late September 2012 was set for the trial, I was concerned that my witness may not have returned to New Hampshire by this time. Before I had a chance to file another continuance request, I received one from the state’s attorney Heather Flanner, which requested the trial be moved to a date later than October 25. I did not object to the continuance, but apparently it must have been withdrawn by the prosecution, because on September 28, I received a Notice of Fine from the court, claiming that I had been found guilty in abstentia for a trial date that I had missed on September 25. One may have noticed that a good amount of the content featured here in the past week has followed a bicycle headlamp trial endeavor of this blog’s editor, Garret Ean. The full trial video with very minimal editing has finished uploading and is now available via youtube.com/freeconcordtv. About 2/3 of the video’s fifty-four minute run time consists of the cross examination of detaining officer Michael Pearl. The raw videos from which the complete piece was crafted have been available since shortly after the event at Fr33manTVraw. There has been an entry featuring new media from the trial almost every day since, including coverage of the camera fiasco prior to the trial, a raw podcast segment overviewing the trial, and a visually illustrated discussion of court issues from Tuesday evening’s episode of Free Talk Live.

It was a cold and rainy morning as the Bearcat attack truck was put on display to the public for the first time in Keene, New Hampshire. Between nine and eleven ante meridiem, the Ballistic Engineered Armored Response Counter Attack Truck was on display with the motor running and the rear doors open, revealing the personnel carrying compartment which seats eight. With the driver and passenger seat, the truck fits ten commandos comfortably, and came standard with no less than ten gun ports. While the KPD didn’t receive the additional gas injector arm, LRAD, or a .50 caliber to mount atop their rotating turret, the powerful fixed FLIR camera gives the department new vision as hunters. The infrared lens can see warm bodies in the darkness, as the image is created by detecting thermal signatures instead of light, akin to the alien antagonist in the sci-fi thriller Predator.

Among those who braved the weather, there was much speculation as to how the Bearcat would be first put to use. While those who tried selling the prospect of the Bearcat to the people claimed it could be used as a rescue vehicle, tour guides acknowledged that it was a standard Ford pickup truck on an enhanced frame with armor. It is not capable of traversing flood waters any more than its unarmored counterpart, beyond the additional elevation provided by the large wheels.
The attack truck is equipped with environmental detectors on the exterior of the vehicle. The sensors are capable of recognizing certain chemical, biological, and radiation dangers. However, the interior itself is in no way insulated from any of these potential threats, as it does not have its own pressurized cabin. The boondoggle also features three spotlights, and all the flashes and noises one would expect from a police vehicle. (more…)
