Historic Constitutional Amendment Filed for NH to Exit United States

Thanks to two heroic state representatives, New Hampshire has now taken the lead nationally in the independence movement. Yesterday, five-term state rep Mike Sylvia filed the text of a constitutional amendment that would, if passed, declare independence from the United States:

“Are you in favor of amending the first part of the New Hampshire Constitution by inserting, after article 7, a new article to read as follows:

 

[Art.] 7-a. [Independent Nation.] New Hampshire declares itself as independent from the United States and peaceably, immediately proceeds as a sovereign nation. All other references to the United States in this constitution and state statutes and regulations are nullified.”

To pass, it must first receive over 60% of the vote in both the state house and senate. If it does, it will then be placed on the 2022 ballot and then must receive over 2/3rds of the vote to be enacted. If so, it goes into effect immediately. There would be no political games like with United Kingdom’s “Brexit” from the European Union, which took several years to hammer out after the vote. New Hampshire will instantly declare our independence and nullify all standing agreements with the federal government gang. Compare this to the thus-far unsuccessful attempts in other US states.

In recent years, secession movements around the country have sprung up and made headlines in California and Texas, but with very little legislative support. In Texas, a state rep filed a bill this year that if passed, would merely have placed a non-binding referendum on the ballot for Texas voters to register their opinion on whether the Texas legislature should begin an arduous process of figuring out how to leave the United States. This bill’s filing resulted in plenty of media coverage and discussion, however, it died before even receiving a committee hearing. A key reason that New Hampshire was chosen as the destination for the Free State Project is that EVERY bill gets a public committee hearing, no matter how much support it has from the state reps. Most states are like Texas, where it’s a political game whether a bill even gets a hearing.

In California, a left-leaning group called “Yes California” has been trying for years to get an independence question on the ballot by gathering the hundreds-of-thousands of required signatures. If passed, the measure would require the legislature to declare independence from the US and become its own republic. So far, they have been unsuccessful despite garnering significant media coverage. Currently their website is offline, though their Twitter is still active. Even if they do get the question on the ballot and it passes, they may not survive the inevitable court challenge given the CA state constitution provides that California, “is an inseparable part of the United States of America.”

While I want to see both Texas and California exit the United States, it’s clear that with the filing of this constitutional amendment bill – called in NH a “CACR” or, “Constitutional Amendment Concurrent Resolution” – that New Hampshire has taken the clear lead in the race to see who will leave the union first. Plus, unlike California, the NH constitution clearly protects the “Right of Revolution” in Article 10 and “State Sovereignty” in Article 7 of the NH Bill of Rights.

Representative Sylvia, in an exclusive interview with Free Keene, had this to say on why he filed the proposed amendment, “The people of America have forgotten their history, if we take the time to look at our roots we can see that our constitutions have received ‘lip service’ for far too long. While I can not change the direction of the federal government, I can hold up the New Hampshire constitution and demand that we honor its clear directives. Article 10 reads in part, ‘whenever the ends of government are perverted, and public liberty manifestly endangered, and all other means of redress are ineffectual, the people may, and of right ought to reform the old, or establish a new government.'”

The 2018 liberty “Legislator of the Year” representative Sylvia is joined by freshman state rep from the Keene area, Matt Santonastaso as the co-sponsor of the amendment. Other state reps have been approached and have expressed support and a full list will be released when the amendment is assigned a CACR number and moves onto a committee.

The process is just beginning, with Sylvia submitting the proposed text to NH Legislative Services on Monday. It may take several weeks for them to officially draft the CACR and send it back to Sylvia for final approval. It then is assigned to a committee which will then hold a public hearing sometime in early 2022. What happens from there is up to the committee and will largely depend on how much public support the amendment receives at its hearing.

Even if it doesn’t pass this time, it will get many conversations started about the evil federal government and why peacefully declaring independence is the best solution. Minds will be persuaded and changed. Many media and political attacks will be brought against us, as the power-seekers will be desperate to keep the status quo. Potential migrants to New Hampshire will be energized and make-the-move.

Hey New Hampshire government gang: Merry Christmas… YOU’RE FIRED!

In Concord on Monday December 21st of 2020 at ten a.m., a group of over one hundred people from across New Hampshire gathered at the now-closed state house steps to invoke their Right of Revolution as specified in Article Ten of the Bill of Rights of the NH Constitution. It states:

Government being instituted for the common benefit, protection, and security, of the whole community, and not for the private interest or emolument of any one man, family, or class of men; therefore, whenever the ends of government are perverted, and public liberty manifestly endangered, and all other means of redress are ineffectual, the people may, and of right ought to reform the old, or establish a new government. The doctrine of nonresistance against arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.

Dan Richard of the New Hampshire Committee of Safety led the event and read aloud a new Declaration of Independence, which you can download a PDF of here. Richard says this is the first time the Right of Revolution has been invoked and that the document serves as a termination of “the state” and its various office holders.

The new Declaration cites various tyrannies, including the unconstitutional “emergency powers” statute that led to the over seventy-five emergency orders issued this year by King Sununu that has trashed the New Hampshire economy and freedoms here generally. Plus, the now-hidden nature of the state gang’s activities makes them completely unaccountable, violating Article Eight of the NH Constitution’s Bill of Rights which requires its government to be open and accountable. Further, the new Declaration claims the voting system was illegally and unconstitutionally manipulated out-of-view from the people and calls the entire election fraudulent as a result.

It calls out the state bureaucracy’s endless harassment of the people as well as the “standing armies of enforcement agents” enacting the tyranny, and the now-secret courts. The new Declaration states that effective means for redress of grievances have been abolished and that, “Our form of government, has become a complete system of tyranny. The Same party is the legislator, the accuser, the judge, and the executioner by declaring themselves invested with power to legislate in secret in all cases whatsoever.”

Citing NH’s Article Ten, the new Declaration dissolves all political connections between the state and the citizenry, absolving us of any allegiance to “the state”.

The crowd of revolutionaries then shouted “YOU’RE FIRED!” in unison and signed the new Declaration of Independence for New Hampshire.

Afterwards, a copy was delivered to the Secretary of State’s office and the Attorney General’s office. It was subsequently served on “governor” Chris Sununu hiding in his home on Christmas Eve. BREAKING: Mask Mandate Protest Planned Sunday at NH Governor’s Home

Keene activists have a history of protests at corrupt bureaucrats’ homes. Now we’re going to the tyrant king himself, with likely dozens of others from across New Hampshire. Chris Sununu, referred to as “HIS EXCELLENCY” in the dozens of “orders” he’s issued in 2020, has now released “Emergency Order #74“. This latest diktat has imposed a statewide mask mandate:

Beginning on November 20, 2020, all persons over the age of 5 within the State of New Hampshire shall wear a mask or cloth face covering over their noses and mouths any time they are in public spaces, indoors or outdoors, where they are unable to or do not consistently maintain a physical distance of at least six feet from persons outside their own households.

While the order does include large loopholes for medical and other exemptions, Sununu’s orders have always included ways out for those paying attention. But most people just believe what the media tells them or that they hear through the rumor mill. They don’t actually read the orders. How could they? There are dozens of them and legalese is purposefully difficult to comprehend.

Regardless of the exemptions, Sununu keeps cranking out orders, until recently just issuing the threats with little enforcement. This Fall however, Sununu’s attorney general, Gordon J MacDonald – a bureaucrat from California – has started issuing fines against businesses. In October the governor’s goons targeted a bar in Hudson for hosting karaoke and fining them $2,000. This week, MacDonald issued $500 threats to multiple food service establishments. It’s not clear if any of the targets are fighting back against the thuggery. Based on their facebook page’s posts, the Hudson bar has sadly been sold and the new owners are showing off for the state and its snitches how obedient their new karaoke setup is to the arbitrary rules imposed on them by the state gang. It’s sad.

A select few are pushing back here in Keene, but despite being sued in federal court by a heroic Keene restaurant over his previous mask mandate on groups of over a hundred people, Sununu has doubled down and mandated masks statewide. Some are saying that there is no penalty, so no big deal. These people are uninformed. There does not need to be a penalty in each “emergency order”. In a previous executive order, #65, Sununu proclaims: “Violations of any Emergency Order, rule, or regulation issued under the State of Emergency are subject to the penalty provision under RSA 21-P:47.”, which says “If any person violates or attempts to violate any order, rule, or regulation made pursuant to this subdivision, such person shall be guilty of a misdemeanor.” While the entire concept of “emergency powers” is likely unconstitutional, I don’t know if anyone has ever challenged the enabling statute, RSA 4:47, in court, so it stands.

Occasionally this year, there had been discussion among activists of a protest at Sununu’s home, but the support never really galvanized like it has now. Sununu’s new mask mandate was the final straw for those who erroneously hoped that he was going to change for the better for some reason now that he won re-election. Any such illusion has been wiped away as “HIS EXCELLENCY” has decreed over-and-over again various provisions making New Hampshire very much like Maskachusetts. As a result of his latest step towards crushing the souls of the good people of New Hampshire, people are finally standing up and moving the protests from the state house in Concord, to Sununu’s home in 71 Hemlock Ct, Newfields, NH.

The first event of what may be a series is expected to take place at 2pm this Sunday November 22nd. Creative signs are welcome and “Absolute Defiance” has also called for pots and pans to be banged. It will be the first time in the nearly fifteen years I’ve been here that I’ve ever heard of liberty activists targeting the “governor” at home. It’s historic.

Some will inevitably complain, “Oh his poor wife and children. It’s not fair to punish them for Sununu’s bad deeds. Just keep your protests to his office in Concord and other public appearances!” To them, I say: “HIS EXCELLENCY” and his precious orders have ruined countless businesses and lives. He’s put people out of good jobs with his “guidance” that is written and enforced as threats of violence. He’s not just suggesting people listen to him, he’s demanding it. He’s invading our private property and lives and it’s only fair we bring the consequences to his doorstep. If his wife Valerie doesn’t like our freedom of speech, maybe she should have a talk with her husband in the way only a wife can and tell him to stop hurting peaceful people.

Due to a scheduling conflict we’ve pushed back the start time for the “Karen VS Nobody” NH gubernatorial debate this Friday, August 28th to 3pm Eastern. The participants are Republican candidates for New Hampshire governor Karen Testerman, biologist and Franklin city councilor, and “Nobody“, the libertarian activist who changed his name to run for office.

Questions are being submitted by both candidates to the debate moderator – nationally syndicated talk show host Mark Edge. We’re also asking you to submit your questions for the two Republican challengers to tyrant king Chris Sununu. By the way, Sununu’s campaign did not respond to the debate invitation. “Nobody”, the New Hampshire candidate for governor challenging incumbent Chris Sununu in the republican primary has already gotten coverage in the Boston Globe for his announcement of an event to challenge Sununu’s outrageous ban on free assembly of over 50 people. Actually, as I am writing this article, Sununu just announced at a press conference that he’s now restricting gatherings to no more than TEN people. We’re still waiting on the written “order”, but it will likely be posted here to the governor’s website later.

Last week, Sununu announced multiple “executive orders” that destroyed significant freedoms in New Hampshire, like the freedom to run a restaurant or bar as he threatened business owners if they dare to allow customers to eat or drink in their establishments. The hospitality industry is severely damaged as a result, with all servers out of work, volume of orders significantly down, and many restaurants choosing to close down completely as a result. It is an attack on the right to serve our neighbors who wish to take whatever risk and go out to eat. People who wish to quarantine themselves are free to do so without a “order” from the governor but those who wish to continue living a normal life or run their business are being threatened by state agents if they do, all under the excuse of “public health”.

Another of his executive orders trampled on the basic human right of assembly – being able to get together with other people. This weekend, Nobody announced an event to challenge Sununu’s order by violating it with over 50 people gathering on the state house steps on Wednesday April 1st at 2pm. While we were pretty sure at the time we could get at least fifty-one people to come to the state house, now that it’s been reduced to ten people it’s a certainty that we can do it, as this weekend sixteen people gathered in Keene for our regular “Social Sunday” meeting.

On his official campaign blog, ElectNobody.com, Nobody announced the civil disobedience event and reminded people where the state’s supposed motto came from: “Live free or die; death is not the worst of evils.” – General John Stark. Before last week, New Hampshire was not a free state, but now all illusions of freedom have been completely wiped away and it’s become all-out tyranny. Something must be done. It’s time to stand up for the freedom to assemble.
